On August 24, 2023, President’s Council approved the following policy actions.

Who does this apply to? Employees who are whistleblowers

Now that this policy draft is in Stage 4, what does this mean for me? If you are a university employee who is a whistleblower, the law and this policy protect you from retaliation (or being punished for participating in whistleblowing). This policy revision incorporates changes made to the Utah Protection of Public Employees Act (UPPEA) by Senate Bill 40 and provides a procedural framework for USHE universities to follow when a USHE employee files a complaint for whistleblower retaliation with their university. Key updates to this policy include 

  • the creation of a procedural framework for Policy 168 whistleblower retaliation investigations and hearings,  
  • language that ensures compliance with the UPPEA 30-day deadline for whistleblower retaliation claims, and 
  • the addition of language for the dismissal of meritless complaints.

Who does this apply to? Staff employees

Now that this policy draft is in Stage 1, what does this mean for me? The current UVU Policy 371 doesn't comply with the Utah System of Higher Education (USHE) Policy R841 regarding the minimum requirements of disciplinary actions for staff.USHE’s policy lists the minimum requirements for job-related reasons for sanctions (or disciplinary actions). UVU Policy 371 lists grounds for involuntary termination but does not list reasons for sanctions (not including termination) and does not align with USHE’s termination grounds.USHE’s minimum requirements policy also states that any employee who is given a sanction must be given the chance to respond to the allegations and the proposed sanction, which is not in the current Policy 371. In addition, the content between the current Policy 371 for corrective actions and Policy 335 for staff grievances is also not consistent, which People and Culture will align through the revisions, particularly in terms of notification requirements and the appeals process.  

 

Policy 607 Course-Based Fees for Credit Courses

Who does this apply to?Employees involved in the process for creating, reviewing, revising, and repealing course-based fees for credit courses and the appropriate use of course-based fee revenues

Now that this policy draft is in Stage 3, what does this mean for me? The policy owners added new material to the draft at the end of Stage 3. To give shared governance entities the opportunity to review these additional revisions, the policy has been approved to enter Stage 3 again for seven days. You can review the new revisions in the Summary of Comments tables by scrolling to page 25. If you wish to make additional comments during Stage 3, please email comments to Laurie Sharp, the policy steward, by August 31.

Who does this apply to? Any UVU employee whose responsibilities may involve managing sponsored programs/external funds, using financial resources wisely, participating in payroll administration, and/or implementing and complying with Utah state law and Utah Board of Higher Education policies for managing institutional funds and investments 

Now that this policy draft is in Stage 4, what does this mean for me? On September 28, the Board of Trustees will review and approve the policy. If your job responsibilities are governed in part by this policy, you may benefit from reviewing it with your team.
