On Friday, December 11, 2020, the UVU Board of Trustees Executive Council approved two Temporary Emergency policies:
Policy 326 Workplace Conduct (Temporary Emergency)

About: The Utah Public Employees Healthy Workplace Act (Utah Code § 67-26-203) prohibits
employees of higher education from engaging in “abusive conduct” against another employee.
The Act was enacted in 2020 to require each public institution of higher education
to implement a policy prohibiting, reporting, and resolving abusive conduct within
the higher education institution. The Act stipulates January 1 as the deadline by
which institutions must have a policy in place. This temporary emergency policy satisfies
that requirement.

Policy 359 Emergency Paid Sick Leave (Temporary Emergency)

About: The federal government has currently not extended the Families First Coronavirus Response
Act (FFCRA) which provided employees two emergency leave options. The most utilized
option by UVU employees has been Emergency Paid Sick Leave (EPSL). Through EPSL,
the FFCRA required many employers (including UVU) to offer two weeks (up to 80 hours)
to all employees (two-week hours equivalent for part-time) of paid leave for specified
categories of COVID-related reasons. The FFCRA will expire on December 31, 2020. In
the absence of the federal government extension of the FFCRA and to ensure the safety
of campus, the adoption of this policy will provide UVU employees with Emergency Paid
Sick Leave beginning January 1, 2021, through the enactment of new, related federal
legislation; the rescission of the statewide public health emergency order due to
the COVID-19 pandemic; or December 31, 2021. This UVU policy utilizes the same eligibility
criteria and paid leave access as the existing FFCRA EPSL for the 2021 calendar year.

Due to the time-sensitive nature of these policies, these policies were approved by the Executive Council of the Board of Trustees and will be ratified on January 28, 2021, by the full Board of Trustees. Temporary Emergency policies remain in effect for up to a year or until a corresponding policy is passed through the Regular policy process, whichever comes first.
